Pick-Packs enables users to browse and order the products and services offered on the Website. By accessing smilykiddos.ae, ordering any product or service, or otherwise using the Website, you agree to be bound by these Terms. If you do not agree to these Terms and Conditions of use, you shall not use this website. The Site reserves the right, to change, modify, add, or remove portions of these Terms and Conditions of use at any time. Changes will be effective when posted on the Site with no other notice provided. Please check these Terms and Conditions of use regularly for updates. Your continued use of the Site following the posting of changes to these Terms and Conditions of use constitutes your acceptance of those changes.

The personal information you provide to Pick-Packs in the course of using the Website will be used in accordance with our Privacy Policy, the terms of which are hereby incorporated into these Terms.
OFFERS
Unless stated otherwise all offers or promotions displayed on Pick-Packs or advertised via our social media channels can only be redeemed by purchasing via our online store, Pick-Packs. For the avoidance of doubt, this means we will not be able to match these prices or promotions in our offline stores.
Product’s Pricing
Errors may occur in the process of providing product and pricing information by Pick-Packs. Pick-Packs cannot confirm the price of a product except after ordering.
In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, Pick-Packs shall have the right, at its sole discretion, to either contact you for instructions or cancel your order and notify you of such cancellation.
In the event that Pick-Packs accepts your order, the same shall be debited to your credit card account and duly notified to you by email that the payment has been processed. The payment may be processed prior to Pick-Packs dispatch of the product that you have ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit card account. No cash disbursement shall be made under any condition whatsoever.
Sometimes a price online does not match the price in a store.
In our effort to maintain the fact of being the lowest price provider in the India, store pricing will sometimes differ from online prices. Prices and availability are subject to change without any prior notice.
ORDERING AND PAYMENT
If you use Pick-Packs to order products and services, you agree to pay the full amount payable for such products and services as indicated during the order process, along with any shipping costs or other charges applicable to that order.
(The currency in which prices are displayed may vary, so please pay particular attention to the currency you select.) If the issuer of your credit or debit card refuses to authorize payment, we will cancel your order and contact you for an alternative method of payment. We cannot be held responsible if this results in a delay in dispatching your order. We may not accept your order in a variety of situations, including:
- the item is out of stock,
- shipping restrictions apply to a particular product or service,
- we are unable to obtain authorisation for your payment,
- we find a pricing error,
- or any other reason (at our sole discretion).
We will not process your payment (or cease processing your order) in these types of situations, and will not be liable to you or to any third party by reason of our decision to decline processing, or unwinding or suspending any transaction after processing has begun. We reserve the right to refuse service, terminate your account, or cancel orders, at our sole discretion.
Cancellations by the Customer
If cancellation notice from your side is duly received by Pick-Packs and the order has not been processed/approved by Pick-Packs, we shall cancel the order and refund the entire amount. Smilykiddos.ae will not be able to cancel orders that have already been shipped out by us.
TRADEMARKS AND COPYRIGHTS
All intellectual property rights, whether registered or unregistered, in the Site, information content on the Site and all the website design, including, but not limited to, text, graphics, software, photos, video, music, sound, and their selection and arrangement, and all software compilations, underlying source code and software shall remain our property. The entire contents of the Site also are protected by copyright as a collective work under the Indian copyright laws and international conventions. All rights are reserved.
Indemnity
You agree to defend, indemnify and hold harmless Pick-Packs and its affiliates from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the Website or any breach by you of these Terms and Conditions and/or the applicable laws.
Termination
These Terms and Conditions is effective unless and until terminated by either you or Pick-Packs. You may terminate these Terms and Conditions at any time, provided that you discontinue any further use of this Website. Pick-Packs may terminate these Terms and Conditions at any time and may do so immediately without notice, and accordingly deny you access to the Website, Such termination will be without any liability to Pick-Packs.
